These terms of use (“Terms”) set forth herein apply to the website, social media and other platforms owned, operated, licensed, and/or controlled by Lagoon Seafood Products inc. and/or its affiliates and subsidiaries, including Azure Foods inc. (collectively, “LSF”, “we”, “us” or “our”) (the “Platform”).
The Platform is provided by LSF as a service to our customers and the public (“you”). By accessing or using the Platform, you unconditionally consent to be bound by these Terms and all applicable laws. Access to the Platform is limited to personal, non-commercial use. If you do not agree with these Terms, you may not access the Platform.
LSF reserves the right to amend the Terms at any time and without prior notice. Your access of the Platform constitutes an unconditional acceptance of and agreement to the then-current Terms. You are responsible for reading these Terms and any subsequent amendments thereto.
LSF reserves the right, at its sole discretion, to modify at any time the Platform or any part thereof, to suspend the Platform, to modify or withdraw services or products offered thereon, without notice or delay. LSF shall not incur any liability to any party for any loss or damages that may result of such change of the Platform, directly or indirectly. You agree that it is your responsibility to monitor any changes to the material and the information contained on the Platform.
By using the Platform, you represent and warrant that you are above the age of majority in your province or territory of residence. Parents must monitor their children’s use of the Internet and are responsible, in their capacity as legal guardian, for determining which websites may or may not be appropriate for children.
The Platform may contain hyperlinks to external websites, owned and operated by third parties. LSF does not control or oversee these external websites and does not monitor or guarantee their content, nor their security or accuracy. You are fully responsible for your use of these websites and fully release LSF from all liability associated with such use. These hyperlinks are offered solely for your convenience. Including a hyperlink to a third-party website shall not, under any circumstances, be interpreted or construed as an endorsement, by LSF, of any representation or information contained on any such website or as a partnership or affiliation with its owner. Your use of third-party websites is governed by their own terms and conditions. We highly recommend that you make yourself aware of and carefully read the legal and privacy notices of all other websites that you visit.
The Platform is provided to you on an “as is” and “as available” basis and, consequently, LSF gives no warranties of any kind, whether express, implied, statutory or otherwise (including the implied warranties of merchantability or satisfactory quality and fitness for a particular purpose) including warranties or representations that material on the Platform will be complete, accurate, reliable, timely, non-infringing to third parties, that access to the Platform will be uninterrupted or error-free or free from viruses, that the Platform will be secure, that any advice or opinion obtained from LSF through the Platform is accurate or to be relied upon and any representations or warranties thereto are accordingly expressly disclaimed. The material on the Platform is provided for informational purposes only. We do not guarantee that the content will meet your expectations, nor that the information, which includes advertising as well as nutritional and health tips, is appropriate for your needs and health conditions.
Descriptions, information, representations, warranties and other content about products or services contained on the Platform may be provided by vendors, partners, or other third parties and have not been independently verified by us. The accuracy of this content is the responsibility of these third parties. LSF does not represent or guarantee that the information or offerings on the Platform are accurate or error-free.
We make no representation that content on the Platform is appropriate or available for use in locations outside of Canada. If you access the Platform from another location, you acknowledge that you do so on your own initiative and that you are solely responsible for compliance with local laws.
Any reliance upon the material on the Platform shall be at your own risk. Price errors or product/service description errors or inaccuracies, including colour, origin, category or other characteristics may occur.

LSF shall have no liability whatsoever for any loss, damage, cost or claim of any kind, whether direct or indirect, incidental, exemplary, punitive, special or consequential, arising out of your access, use, inability to use, change in content, or arising from other websites you access through a hyperlink.
LSF shall have no responsibility to maintain the material and services made available on the Platform or to supply any corrections, updates, or releases in connection therewith. Any material on the Platform is subject to change without notice.
Further, LSF shall have no liability or any responsibility whatsoever for any loss suffered caused by viruses that may infect your computer equipment or other property by reason of your use of, access to or downloading of any material from the Platform. If you choose to download material from the Platform, you do so at your own risk.
Your sole and exclusive remedy is to discontinue accessing and using the Platform. Nothing on the Platform should be interpreted as creating any warranty beyond what is explicitly stated in these Terms.
To the maximum extent permitted by applicable law, you expressly waive all claims against LSF, its officers, directors, employees, suppliers and programmers that may arise from your use or access of the Platform.
All the content of the Platform, including the text, logos, slogans, images, drawings, graphics, illustrations, photographs, videos, musical excerpts, downloads, technical programs and business processes, is owned or otherwise provided or used under license by LSF. LSF does not represent or warrant that any uploaded content from third parties does not infringe the rights of any third party. All the content of the Platform is subject and protected by LSF’s intellectual property rights and all applicable worldwide intellectual property laws and international treaties. Any unauthorized use of the content of the Platform, including any reproduction, distribution or redistribution, transmission or retransmission, communication to the public by telecommunication, performance, translation, distribution to the public or downloading is prohibited without the prior written authorization of LSF.
The logos and trademarks displayed on the Platform are trademarks, registered or unregistered, of LSF or third parties, which are the property of their respective owners. The trademarks displayed on the Platform cannot be used without the prior written authorization of LSF or their respective owners.
No element of the Platform shall be interpreted as creating, implicitly or expressly, a license or a right of use or of duplication of LSF’s or third party’s intellectual property rights.
You may download, where specifically permitted, one copy of the content displayed on the Platform on any single computer for your personal, non-commercial use only, provided you keep intact all copyright and other proprietary notices. Use of such content for any purpose that is inconsistent with these Terms, including without limitations the use of such content on any other website or networked computer environment is strictly prohibited and shall be deemed a violation of LSF’s copyright and other proprietary (including intellectual property) rights.
LSF’s collection, use and disclosure of your personal information are governed by our Privacy Policy, the terms of which are incorporated into these Terms by reference.
Any non-personal communication or material you transmit to the Platform by electronic mail or otherwise, including any data, questions, comments, suggestions or the like is, and will be treated as, non-confidential and non-proprietary. Anything you transmit or post becomes the property of LSF and may be used for any purpose, including but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting.
Furthermore, LSF is free to use for any purposes whatsoever (including but not limited to the developing, manufacturing, advertising and marketing of products) any ideas, artwork, inventions, developments, suggestions or concepts contained in any communication you send to the Platform. Any such use is without compensation to the party submitting information.
By submitting information, you are also warranting that you own the material/content submitted that it is not defamatory, and that LSF’s use will not violate any third party’s rights or otherwise place us in breach of any applicable laws. LSF is under no obligation to use the information submitted.
You are prohibited from doing any act that LSF, in its absolute discretion, may deem to be inappropriate and/or would be deemed to be an unlawful act or is prohibited by any laws applicable to the Platform, including but not limited to making any attempt whatsoever to collect any information about other users (including their email addresses), violating any laws or third-party rights, use the Platform if you are under the age of majority in your province or territory of residence, distribute viruses or any other technologies that may harm the Platform, or the interests or property of the Platform’s users, attempting to compromise the security, efficiency or effectiveness of the Platform, use the Platform in any way that it is not intended to be used, mimicking the Platform or creating, operating or managing a website deliberately with a similar URL, and sending unsolicited email.
All such actions are against the law and may result in civil or criminal proceedings. We may employ technological measures to detect and prevent fraudulent or abusive use of the Platform.
We reserve the right to restrict, suspend or terminate without notice your access to the Platform or any feature of the Platform or any feature or part thereof at any time.
These Terms represent the entire agreement between you and LSF in relation to the Platform and supersedes all prior discussions, agreements and understandings of every kind and nature. If any provision or any part of any provision of these Terms shall be held to be invalid or unenforceable by a court of competent jurisdiction, such invalidity or unenforceability shall not invalidate or render unenforceable any other portion of these Terms or shall not invalidate or render unenforceable these Terms in any other jurisdiction. No failure by LSF in exercising any right, power or remedy secured hereunder shall operate as a waiver of any such right, power or remedy under these Terms. These Terms will be binding and enure to the benefit of your heirs, executors, administrators or other legal representatives.
Your access of the Platform and these Terms shall be governed, construed and interpreted in accordance with the laws of the province of Quebec and the laws of Canada applicable therein. You agree that all disputes relating to the use of the Platform and these Terms shall be submitted to the exclusive jurisdiction of the courts of Quebec, district of Montreal. We make no representations that the information and content will be available or appropriate in every jurisdiction in which the Platform is accessed.
